What you need to know:
We focus on non-contentious family matters. If your matter is contentious, you should seek another firm to represent you in your matter. We feel that the costs of our services are fair and reasonable as we strive to work with our clients to ensure that your hard-earned money is not spent on legal fees. We can work with both or you to come to the terms of the Agreement, not one or the other.
As our goal is to get our clients where the parties want to be (as long as it complies with the applicable laws), we do not nickel-and-dime you for every email or phone call to get the Agreement where it needs to be. We will provide you with a ballpark estimate for legal fees at our initial meeting and we will stay within that estimated range of fees.
As you are both our clients, nothing will be kept confidential between the three of us (parties/spouses and lawyer) as we all need to be very clear about what is taking place.
In the event that matters become contentious to the point of requiring Court intervention, Bergerman Smith LLP will step aside and both of you will be required to hire new lawyers.
If you and your spouse have separated and want to formalize matters pending your divorce (if you decide to get divorced), we can assist with the discussion of legal issues and the drafting of the Agreement that is required to make this happen.
The usual range of fees is usually in the area of $1,500 – $2,000 plus taxes.
Once the Agreement is ready to be signed, one of the parties will be required to sit down with a separate lawyer for Independent Legal Advice (“ILA”) to ensure that this Agreement is really what you want to enter into. That independent lawyer will review your rights and obligations under the Agreement and if you choose to sign after that discussion, you will sign the Agreement. ILA usually costs between $150 – $200 plus taxes.
If you have chosen to live with another individual and want to protect your assets in the event of a separation, in the event that you become common law spouses, or you are planning on getting married, we can assist with putting your Agreement together to protect your current assets in the event that a separation ever takes place.

(1) Uncontested Divorce Proceedings (without children):
If you and your spouse have simply grown apart and want to formalize your divorce, we can assist with the process, paperwork, and any discussion to make this happen. We will work with both or you, not one or the other.
Typically, assuming the parties remain civil with one another, Bergerman Smith LLP charges legal fees in the amount of $1,200 plus Court of Queen’s Bench disbursements ($295) and applicable taxes to complete an uncontested divorce application.
(2) Uncontested Divorce Proceedings (with children):
If children are involved in your uncontested divorce, the custody and access concerning those children needs to be factored into the divorce. This will require additional paperwork and the costs will increase slightly from the amount indicated above. We can discuss any additional costs at our initial meeting.
(3) Contested Divorce Proceedings
At this time Bergerman Smith LLP is not interested in taking on any contested Divorce matters. If your matter is contentious and will require the intervention of the Court of Queen’s Bench of Saskatchewan, we wish you all the best and encourage you to seek another law firm to assist in your matter.
